INTRODUCTION .
The first day of a child’s life is marked by parents who pledge to live in zeal, sacrifice, and hard work. The parents deal with emotional turmoils, financial struggles, and sleepless nights to ensure their child gets the best start in life. Parents put off their own dreams and do a lot of work to support the children. The everyday tasks their child performs shape their identity and purpose. As children age,it’s appropriate for them to repay the love and care. The list consists of emotional support, medical aid, and financial assistance when necessary. By listening, being present, and making sure parents are happy and at ease, children can show gratitude.The objective is to repay those who have given us so much. The constant presence of parents provides us with love, support, and guidance during our trying times. They aim to provide their kids with the best life possible, a better life than they ever imagined, and their love is unwavering. The presence of parents in their children’s lives is unwavering, and they are always available to provide support or listen. Why? As parents give birth to children, they also instruct us on how to live life with empathy and determination.
CHILDS DUTY : Care for the caregivers.
To take care of those who are caring. Many cultures, including Indian culture, have a fundamental obligation to take care of their parents through filial responsibility, which is supported by ancient texts like the Vedas and epics such as the Ramayana. The Maintenance and Welfare of Parents in 2007 Act has made it a legal requirement, not just merely requiring moral compliance.Support and financial assistance are required from the Act for parents aged 60 and above if they cannot afford to pay their bills. It also protects from abuse and exploitation of senior citizens property. The transfer of property can be cancelled if the transferee fails to furnish essential facilities. Parenting can be a challenging task. Additionally,there are many intricate aspects of life, such as employment and financial matters. The expectations of parents may not align with the capabilities of children. Health issues can be a challenge, and the law has been created to address them.Also, there are special courts that can assist in sorting out disputes.
There’s a similar case, Kamalakant Mishra v. Additional Collector and others, Judgment Date(September 25, 2025)where parents evicted their neglectful child from the property.Our law helps to take care of parents and senior citizens. It makes sures to provide money and support to their parents or elderly relatives who can’t take care of themselves.So the law sets up special courts called Maintenance Tribunals to handle these cases.This law is all about making sure elderly parents or relatives get the care and support they need from their children or family members. Special courts, called Maintenance Tribunals, help resolve these cases.The Supreme Court of India even ruled that if a child fails to care for their parents, they can be evicted from the parents property. It’s all about respecting and caring for those who’ve cared for us.An 80 year man and his 78 year wife filed a case against their son, who had taken over their own properties in Mumbai and refused to let them live there.
Our law is designed to provide care for both elderly parents and their loved ones. The maintenance of children or elderly relatives who cannot take care of themselves is ensured by the law through special courts known as Maintenance Tribunals.
The Supreme Court of India has ruled that children who neglect their parents can be removed from their property. Why? Respect and showing affection towards those who have shown us support are the underlying principles of this. The son endeavored to find ways to delegate his responsibilities and prioritize showing care and attention to his parents. Rather than being supportive and understanding, he focused on the law and technicalities. His disregard for the welfare of his parents resulted in the Supreme Court’s ruling in favor of the parents,the judgement subsequently directed the son to vacate the property by November 30, 2025 and pay maintenance of 3,000 per month.
The Maintenance and Welfare of Parents and Senior Citizens Act of 2007 is a significant initiative to safeguard the dignity and rights of elderly parents. This law was passed in 2007. By requiring children to take responsibility for their parents well-being and offering legal remedies for neglect, this law effectively sends a message that neglect can be punished. By encouraging children to manage their parents care, it fosters a sense of respect and compassion for the elderly. In addition to protecting the vulnerable, this law promotes a sense of family unity and fosters an environment that is respectful and caring. And it reminds us of the love and care we share with our loved ones.

CONCLUSION.

And it helps them to realise that what they need and gives you something to rely on if your kids ignore or leave you. This judgment highlights the importance of entrusted duties to our parents in a fast paced world where families are increasingly nuclear and personal priorities often take precedence. And it’s not just about the money,there’ll also be a great deal of love, care and companionship.A large number of individuals may believe that meeting their financial obligations is adequate, but this ruling underscores the importance of emotional support and maintaining a sense of connection. The recent ruling from the court emphasizes the importance of rethinking our approach to ensure that we are treated with respect and dignity in relation to our parents future.
We cannot ignore the emotional responsibilities of parents or isolate them from our family by providing them with just a roof on their head and food. It would be appropriate to show gratitude to our parents for their sacrifices. They require our emotional support and physical presence.Child may face repercussions if its neglectful.The judgement has made it clear that our parents deserve our unconditional love and consideration. We fulfill our duties as children and create a sense of safety and encouragement through this. In the end, this law is a reminder that neglecting our parents can result in legal action. We are not only doing what is right, but we are also giving back to those who have given us so much.
